Acceptance of terms

These Terms and Conditions govern your use of the First Break website and participation in the hobby box application, selection, donation, and live opening program operated by [Organization Legal Name].

By using the website, submitting an application, donating, or participating in a live opening, you agree to these terms, the Privacy Policy, the Program Rules, and any signed media release or consent form.

Eligibility

  • Applicants must be younger than 15 at the time the application is submitted.

  • Applicants must be located in the United States unless the program later expands in writing.
  • Each child may receive only one hobby box opening through the program.
  • No purchase, payment, donation, or social media follow is required to apply or be selected.

Application and selection

Applications may require parent contact information, child eligibility information, a written letter, a short video, sport preference, consent acknowledgments, and agreement to the release.

Selection is based on reviewer judgment, application completeness, authenticity, program fit, available boxes, and the project's mission. Selection is not guaranteed. The project may reject, remove, or disqualify any entry that appears false, duplicated, unsafe, incomplete, manipulated, or inconsistent with these terms.

Finalists must complete a parent-led verification call before final selection. Failure to complete verification may result in removal from consideration.

Live opening and fulfillment

Selected participants must be available for a scheduled live hobby box opening. A parent or legal guardian must be present, on camera or actively supervising, and responsible for the child's participation.

Cards opened for the selected child will be shipped to the parent or legal guardian after the live opening. The project may set reasonable shipping procedures and may require a valid shipping address from the parent or legal guardian after selection.

Donations

Donated boxes and funds support hobby box purchases, shipping, supplies, platform costs, and program operations. Donations do not influence selection and do not create any right to choose applicants, access private submissions, or control project decisions.

Unless [Organization Legal Name] states otherwise in writing, donations are not represented as tax-deductible. Donors are responsible for their own tax, accounting, and recordkeeping decisions.

Media release and content rights

Applications and live openings may include videos, photos, audio, written letters, names, likenesses, voices, and stories. A parent or legal guardian must sign the project's release before a child's content is used publicly for promotional, marketing, fundraising, or community purposes.

If you do not agree to the release, do not submit application materials or participate in a live opening.

Conduct and safety

Participants, parents, guardians, donors, and viewers must not harass applicants, families, reviewers, donors, or project staff. The project may remove comments, end live participation, cancel selection, or block access when conduct is unsafe, abusive, fraudulent, or disruptive.

Disclaimers and limitation of liability

The website and program are provided on an "as is" and "as available" basis. The project does not guarantee specific boxes, cards, values, timing, selection outcomes, stream availability, shipping dates, or resale value.

To the fullest extent allowed by law, [Organization Legal Name] is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages related to the website, applications, donations, live openings, shipping, or participation.
